Dear Stockyard Owners and Operators:

Recently, the handling of downed animals at stockyards has received considerable, and unfavorable, attention in the media. Attention has been focused on the handling of downed animals at stockyards. While a vast majority of livestock receive proper care and handling at markets, it has become apparent that there are problems at some stockyards that must be solved quickly and effectively.

The livestock industry has held a conference to address the issue. A position statement and a statement of program objectives on animal care were prepared by conferees. There is a general agreement that tlivestock in marketing channels must be cared for and handled in a manner that is consistent with the animals' welfare. In addition to these positive industry steps, some stockyards have adopted a "no downer" policy. Additional steps must be taken to assure that proper care and handling are provided. Government and industry must utilize their appropriate and respective roles to seek solutions.

Many stockyards may encounter difficulty in handling downed animals humanely. Under such circumstances, it is the opinion of the Packers and Stockyards Administration (P&SA) that the most effective solution is for stockyards to refuse to accept such livestock.

On May 17, 1991, P&SA initiated a routine surveillance program to review the handling practices, services, and facilities at stockyards.

Program objectives are: (1) determine whether the current procedures and practices provide proper care and handling of livestock at stockyards; and (2) determine whether the stockyard services and facilities are adequate to minimize injury and prevent unnecessary suffering.

Evidence of improper handling of livestock at stockyards uncovered by these investigative activities will be dealt with through appropriate corrective action by the Agency. This will incude action consistent with the existing P&SA authority and referral of cases not addressed by P&SA authority to State, local, and other officials who have jurisdiction over humane treatment of livestock.
